उक्त अधिकारी के मुताबिक, हम सभी मंत्रालयों के बीच में चर्चा हुई है और हमने तय किया है कि जब सभी SRB मामले पर सहमत होंगे, तभी इस तभी SRB को लेकर आगे बढ़ाया जाएगा।

जीएसटी परिषद की 52वीं बैठक 7अक्टूबर 2023 को नई दिल्ली के विज्ञान भवन में आयोजित होने वाली है। इस बैठक में परिषद ऑनलाइन गेमिंग, कैसिनो और हॉर्स रेसिंग पर 28 फीसदी जीएसटी लागू करने पर चर्चा कर सकती है। गौरतलब है कि पिछले बैठक में ऑनलाइन गेमिंग पर फैसला किया गया था और उसके बाद गेमिंग कंपनियों ने इसका विरोध किया था। वहीं अब गेमिंग कंपनियों को जीएसटी के लिए नोटिस भी देने की तैयारी है। लिहाजा ये बैठक काफी अहम मानी जा रही है।

अब तक, केवल कुछ राज्यों ने नए जीएसटी संशोधनों को पारित किया है। दिल्ली, सिक्किम और गोवा सहित तीन राज्यों ने पहले नई जीएसटी दर के खिलाफ मतदान किया था। अब आगामी बैठक में इन राज्यों को इस मामले पर पुनर्विचार करने की उम्मीद है। ऑनलाइन गेमिंग, कैसिनो और हॉर्स रेसिंग के लिए नई कर व्यवस्था 1 अक्टूबर से लागू होना है। हालांकि, कई राज्यों ने अभी तक नई जीएसटी दर में संशोधन नहीं किया है। यह भी स्पष्ट नहीं है कि 52वीं जीएसटी परिषद की बैठक के लिए नियोजित एजेंडे में क्या है।

ऑनलाइन गेम्स में 28 फीसदी जीएसटी की फैसले के बाद गेमिंग कंपनियों की दिक्कतें लगातार बढ़ रही हैं। अब डीजीजीआई अब करीब 100 कंपनियों के खिलाफ जीएसटी चोरी की जांच करने की तैयारी में है। इसी बीच फैंटेसी गेमिंग प्लेटफॉर्म ड्रीम 11 की मूल कंपनी ड्रीम स्पोर्ट्स ने कथित कर चोरी के लिए जीएसटी द्वारा दिए गए कर नोटिस के खिलाफ एक रिट याचिका दायर करते हुए बॉम्बे हाईकोर्ट का दरवाजा खटखटाया है।

मीडिया साइट मनीकंट्रोल के अनुसार कंपनी का दावा है कि जीएसटी राशि लगभग 40,000 करोड़ रुपये होने का अनुमान है, जो गेमक्राफ्ट को भुगतान करने के लिए दिए गए नोटिस से दोगुनी है। हालांकि कुछ अन्य का अनुमान है कि यह लगभग 25,000 करोड़ रुपये है। असल में इससे पहले जीएसटी की तरफ से गेम क्राफ्ट को नोटिस भेजा जा चुका है और ये मामला सुप्रीम कोर्ट में चल रहा है और इस पर आठ अक्टूबर को इस मामले में सुनवाई होनी है। केंद्रीय अप्रत्यक्ष कर और सीमा शुल्क बोर्ड (सीबीआईसी) कई ऑनलाइन रियल मनी गेमिंग फर्मों को नोटिस भेजने की योजना बना रहा था। नोटिस के अनुसार, कंपनियों को अगस्त 2017 से जून 2022 की अवधि के लिए जीएसटी बकाया का भुगतान करना होगा।

फिलहाल ड्रीम स्पोर्ट्स को भेजे गए नोटिस में मांगी गई राशि कथित तौर पर गेमक्राफ्ट को मिली राशि से अधिक है। जिसको लेकर कंपनी को आपत्ति है। फिलहाल उच्चतम न्यायालय में गेमक्राफ्ट को दिए गए नोटिस पर सुनवाई कर रहा है जिसने इस साल की शुरुआत में कर नोटिस को रद्द करने के कर्नाटक उच्च न्यायालय के फैसले पर स्थगन आदेश जारी किया था।

गौरतलब है कि वित्त मंत्री निर्मला सीतारमण की अध्यक्षता में जीएसटी परिषद की 50वीं बैठक में 28 प्रतिशत जीएसटी दर को लागू करने का निर्णय लिया गया। हालांकि राजस्व सचिव संजय मल्होत्रा के अनुसार, 28 फीसदी जीएसटी कुछ नया नहीं है। उन्होंने खुलासा किया कि रियल मनी गेम्स को हमेशा 28 फीसदी टैक्स लगाया जाता था, जबकि प्लेटफॉर्म बेस गेमिंग के रेवेन्यू में 18 फीसदी का टैक्स लगाया जाता था।

पौड़ी गढ़वाल की एसएसपी श्वेता चौबे ने बताया कि जिस वक्त इस रिजॉर्ट पर रेड हुई थी, तो वहां वैलनेस सेंटर के भीतर यह जुआ चल रहा थाष बाद में पूछताछ में पता चला कि हरिद्वार का रहने वाले विशाल ने यहां जुआ खिलाने का बंदोबस्त किया था। पुलिस को यहां से ₹6 लाख कैश, लगभग 4000 पॉकेट चिप्स और 37 मोबाइल फोन बरामद हुए हैं। इस रिसोर्ट के मालिक डॉक्टर आरके गुप्ता को भी गिरफ्तार किया गया है।

रियल मनी गेमिंग कंपनियों के कारोबार पर केंद्र सरकार पिछले कुछ समय से लगातार प्रहार कर रही है। पहले इस सेक्टर पर जीएसटी 28 परसेंट किया गया और अब लगातार कंपनियों को जीएसटी चोरी के बड़े बड़े नोटिस भेजे जा रहे हैं। अभी तक कुल मिलाकर एक लाख करोड़ रुपये से ज्य़ादा के टैक्स चोरी के नोटिस कंपनियों को मिल चुके हैं।

डायरेक्टर जनरल GST इंटेलिजेंस ने ऑनलाइन रियल मनी गेमिंग कंपनियों पर जीएसटी का सर्जिकल स्ट्राइक कर दिया है। डायरेक्टर जनरल जीएसटी इंटेलिजेंस (DGGI) ने गेमिंग इंडस्ट्री पर पिछले कुछ समय में ही एक लाख करोड़ रुपये से ज्य़ादा की टैक्स चोरी के नोटिस भेजे हैं। सोमवार को जहां जहां Dream11 को ₹25,000 करोड रुपए का जीएसटी चोरी का नोटिस भेजा गया। वहीं गेम्स 24/7 को 20000 करोड रुपए की टैक्स चोरी का नोटिस भेजा गया है।

इंडस्ट्री से जुड़े एक व्यक्ति ने बताया जहां Dream11 को 25,000 करोड रुपए का कारण बताओं नोटिस भेजा गया है, वही इसके साथ ही रमी सर्किल, my11circle आदि को भी करीब 5000 के जीएसटी चोरी के नोटिस भेजे गए हैं। इस तरह से कुल मिलाकर सोमवार को ही 55,000 करोड रुपए के नोटिस रियल मनी गेमिंग कंपनियों को भेजे जा चुके हैं। इससे पहले डेल्टा कॉर्प को करीब 16,800 करोड रुपए की टैक्स चोरी का नोटिस भेजा था।
